One last thought, I'm not a lawyer, but I believe since he basically defrauded you by selling you a refurbished HA and passed off as new without saying so in the contract that it was refurbished the contract is null and void and you are entitled to ALL your money back. So if he try's to keep some of your money for services rendered tell him he basically defrauded you and unless he gives it all back, you will have to take him to small claims court and turn him into the licensing board.

The universal expectation when purchasing anything is that the item is new, unless the distribution channel generally sells used items, such as a pawn shop. The sale of any used item, where the consumer believes it to be new, without the seller disclosing that is used, violates most state laws.
I strongly suggest you contact your state's department of consumer affairs and lodge a formal complaint against this unscrupulous hearing aid dispenser. To bolster your claim, I would further suggest you contact the hearing aid manufacturer with the serial numbers of the aids you purchased and document that they are indeed used. In the event that the dispenser changes his previous admission that the hearing aids are used, it would further demonstrate to law enforcement his poor ethical and legal position. Good luck. |
